The Information Technology Act, 2000 was a much celebrated enactment as India achieved the feet of becoming the 12th nation in the world for having exclusive enactment on Information Technology. The need was felt to enhance the remedies for the contraventions under Section 43 of The Information Technology Act, 2000 and the necessary amendment was made in 2008. Even thought the Amendment of 2008 enhanced the scope of Section 43, still there are many loopholes and gaps which need to be bridged to provide effective implementation for the victims of the contraventions. This article aims to take account of such techno-legal and procedural challenges which need to be addressed with one more amendment in The Information Technology Act, 2000.
